FITDISTRICT MEMBERSHIP TERMS & CONDITIONS

Effective date: 1 October 2026
1. General
  • By purchasing a membership, session pack, or casual visit at Fitdistrict, you agree to these Terms and Conditions in full. These terms apply to all members, casual visitors, and program participants. Fitdistrict may update these terms at any time, with material changes notified via email.
2. Memberships
2.1 Available Memberships
Part-Time: 3 sessions per week at $69/week
All Access: Unlimited sessions at $79/week
All Access Plus: Unlimited sessions with dedicated coaching at $129/week (12-week program)
Foundation Legacy: Unlimited sessions at an exclusive locked-in rate for Foundation members only
  • Foundation rates are held for as long as your membership remains continuous. Once cancelled, the rate is no longer available and any new membership will be subject to current rates.
  • Part-Time sessions reset weekly. Unused sessions do not roll over.
2.2 Activation and Payment
  • Memberships activate on the date of purchase. Weekly payments are automatically debited from your nominated card every 7 days. There is no joining fee and the Athlete Welcome Pack is included from day one. You are required to keep an active card with sufficient funds on file. Card and payment details are updated through Momence.
2.3 Minimum Commitment
  • All memberships require a minimum commitment of 12 weeks, after which your membership continues week-to-week until cancelled under Section 5. Members on a 6 or 12 month commitment arrangement are subject to the additional terms in Section 5.2.
2.4 Non-Transferability
  • Memberships are non-transferable and for the exclusive use of the named member. Access credentials, class credits, and member benefits may not be shared.
    
3. Casual Visits and Session Packs
Casual visit: $35 per session
10 session pack: $300, expires 6 months from date of purchase
20 session pack: $550, expires 12 months from date of purchase
  • Unused credits are forfeited on expiry and are not refundable or transferable. Credits are non-transferable and cannot be shared.
  • Cancellations inside the booking window, or failure to attend, will forfeit the session credit.
    
4. Payments and Failed Payments
  • All transactions are processed securely via Stripe. Pricing is inclusive of all payment processing costs.
  • It is your responsibility to maintain accurate card and contact details and to ensure sufficient funds are available on your billing date.
  • If a payment fails, Stripe will automatically retry. The first attempt incurs no fee. A $10 fee applies to each subsequent failed attempt and is added to your outstanding balance. After three failed attempts your membership is suspended until the balance is cleared.
  • Members remain responsible for all fees incurred during their minimum commitment period regardless of attendance.

5. Cancellation
5.1 Standard Cancellation
  • There are no cancellation fees. Cancellation requires 2 billing cycles notice, submitted in writing to hello@fitdistrict.com.au. Cancellations cannot be processed in studio, by phone, or by SMS.
  • Your final two payments process on your next two scheduled billing dates and your membership remains active until the end of that second cycle. You retain full access throughout the notice period.
  • Cancelling within the 12-week minimum requires payment of the remainder of that period.
5.2 Commitment Arrangements
  • Members on a 6 or 12 month commitment have received complimentary weeks in exchange for that term. If you cancel before the end of the term, the value of those weeks becomes repayable in addition to standard notice.
  • The 12-week minimum commitment in Section 2.3 applies to all memberships, including those on a 6 or 12 month arrangement. Cancelling within the first 12 weeks requires payment of the remainder of that period as well as repayment of any complimentary weeks received.
  • Holds are available during a commitment term. The committed period extends by the length of any hold taken, so the full term is completed.
5.3 Termination by Fitdistrict
  • Fitdistrict may terminate a membership at any time without refund for conduct that breaches these terms or our community standards.
6. Membership Holds
  • Holds are available for injury, illness, or holidays.
  • $10 per week
  • Minimum 7 consecutive days
  • Maximum 8 weeks per calendar year
  • 3 days written notice to hello@fitdistrict.com.au
  • Payments pause and resume where they left off once the hold ends. It is your responsibility to notify us if you wish to extend a hold. Refunds are not issued where correct notice has not been provided.
  • A hold and a cancellation cannot run concurrently. Cancellation notice takes effect only from the date your hold ends.
7. Bookings & Attendance 

71. General Bookings
  • All classes must be pre-booked and pre-paid via Momence. The timetable displays 2 weeks of classes, with bookings opening 7 days in advance.
  • If a spot becomes available from the waitlist, Momence will automatically book the first member on the list. Ensure notifications are enabled.

7.2 Cancellation window
  • Cancel at least 6 hours before AM sessions and 1 hour before PM sessions. All cancellations must be processed through Momence. Text, phone, and email are not accepted.
    
7.3 Late cancel and no-show fee: $15
  • This fee applies if you cancel inside the window above, or fail to attend a booked class. It applies to members, casual visitors, and session pack holders.
  • If you are moved from the waitlist and cannot attend, you must remove yourself before the window closes to avoid the fee.
  • Fitdistrict may waive this fee at its discretion in genuine circumstances.
7.4 Open Gym 
Open Gym is unsupervised training time and is not a coached session. While a coach may be present in the studio, they are not supervising, programming, or instructing during this time.

Members training during Open Gym do so at their own risk and are responsible for their own programming, technique, load selection, and safe use of equipment. If you are unsure about a movement or piece of equipment, ask a coach before attempting it.

All health, safety and liability provisions in these Terms apply to Open Gym in full.
8. Refunds
  • Payments already processed are not refundable. Fitdistrict may issue account credit at its discretion in exceptional circumstances. Nothing in these terms limits your rights under Australian Consumer Law.
    
9. Promotions and Offers
  • One promotional offer per person, and only one active at any time. Duplicate purchases may be cancelled and refunded. Creating multiple accounts to access the same promotion is not permitted and may result in account suspension.
  • Promotional offers do not automatically convert to ongoing memberships unless stated at the time of purchase. Specific terms, including expiry, eligibility, and redemption, are listed at the point of purchase and take precedence where they conflict with these terms.
  • Fitdistrict may modify, suspend, or withdraw any offer at any time without notice.
10. Health and Safety
10.1 Your Responsibility
  • You must notify Fitdistrict of any pre-existing medical conditions, injuries, or physical limitations prior to your first session, and advise us of any change to your health status. It is your responsibility to consult a qualified medical professional before commencing any vigorous exercise program.
  • Do not attend if you have an infectious illness, contagious condition, or physical ailment, including open cuts or sores that may pose a risk to coaches or other members. Inform your coach of any new injury before each session.
  • Fitdistrict may ask a member to cease participation where continuing poses a risk to their health or the safety of others.
10.2 Breathwork
  • Breathwork involves intentional breathing techniques that can produce light-headedness, tingling, or altered states. It is contraindicated for individuals with cardiovascular conditions, epilepsy, respiratory disorders, pregnancy, or certain psychiatric conditions.
  • You must disclose any relevant conditions before participating, follow all coach instructions, and stop immediately if you feel unwell. Fitdistrict coaches are not medical professionals and participation is entirely at your own risk.
11. Minimum Age
  • All participants must be 18 years or older.
12. Risk and Liability
  • By participating in Fitdistrict sessions, including group classes, personal training, open gym, breathwork, and retreats, you acknowledge that physical training involves inherent risks including injury, illness, or death.
  • You accept full responsibility for your participation and agree that neither you, your heirs, assigns, nor legal representatives will make any claim against Fitdistrict, its owners, employees, coaches, or contractors for any personal injury, property damage, loss, or wrongful death arising from your participation, whether caused by negligence or otherwise.
  • A signed Waiver of Liability is required before your first session. Participation without a completed waiver is not permitted.
13. Photography, Communications and Privacy
  • By attending Fitdistrict sessions or events you consent to photographs and video being used for promotional purposes across our website, social media, and marketing materials. No compensation is payable. If you would prefer not to be photographed, notify a coach or contact hello@fitdistrict.com.au.
  • You also consent to receiving communications via email, SMS, and app notifications, including membership updates, schedules, and promotional offers. Keep your contact details current. Fitdistrict is not responsible for missed notifications resulting from outdated details or disabled notifications.
  • Personal, medical, and training information is securely maintained and will not be disclosed to third parties except as required by law or to deliver our services. Full details at fitdistrict.com.au/privacy-policy.
14. Fee Changes and Governing Law
  • Membership fees and service charges may be reviewed periodically. Members will be given a minimum of 14 days written notice of any change. Continued use following notice constitutes acceptance.
These terms are governed by the laws of New South Wales, Australia, and any disputes will be subject to the exclusive jurisdiction of its courts.
